Legal Question in Family Law in Texas

My attorney asked for 3k retainer fee before I began my divorce proceedings. The last statement I got from her said that I still had $400.00 remaining. She called me yesterday and told me that I owe her $800.00. Is this customary legal practice to incur costs without the client's agreement?

Every time the attorney works on your case, you incur costs. It is very customary.

However, if your attorney is incurring significant third-party costs (e.g. depositions, etc.) I would ask to be contacted before such expenditures are made. But the attorney is not going to call you for permission every time he or she works on your case.

Your question did not state what has been done on your case. If your case is progressing (e.g. you have temporary orders in place or you've gone to mediation), those fees are not out of line. If all that has happened is that your divorce was filed, you might want to take a close look at your account statement to make sure you understand everything that has been done on your case.
