Legal Question in Family Law in Texas
Attorney falsifying court documents - need help!!
I am in the middle of a divorce and am currently acting pro se because I am unable to afford an attorney. My wife's attorney sent a letter to me with an attached ''order on first amended motion to compel discovery and for sanctions'' and in the order it says that I was duly notified on 7/20/07 on the record by the 73rd district court and I failed to appear. First of all, I was never notified of such a court date. I called the clerks office at the courthouse where this was supposedly held and she said that this order is false because a court date never occurred and that there are no judgments against me. The clerk continued to say that the courthouse would have sent the order if it were legit. The letter and order came from the opposing attorney's office. Furthermore, I have filed a chapter 7 bankruptcy and the opposing attorney is listed and she is not supposed to harass me but she continues to. This isn't the first order trying to get me to pay her attorney fees. Also, the order to compel is BS anyway because I have answered the interrogatories and have both faxed and emailed them to her. What can I file against her for falsifying court records and for the continued harassment?

You can file an "answer" to her motion.
You need to have proof that you faxed and emailed the documents to her and attach it to your "answer".
