Legal Question in Family Law in Texas
My attorney's secretary is talking to my husband.
My attorney's secretary is talking to my husband.
I filed for a divorce. I found out that my attorney's secretary had been talking to my husband by phone and helping him file his papers so he doesn't have to get an attorney. He call her and she set an appointment to later the support judgement hearing. He is menipulating my attorney's staff. My attorney didn't file the interaggatories for a month. He is dragging his feet on possible embezzlement charges. He has not asked me for evidence of adultry, crulty and STDs. My attorney has an acount with my husband's business which is the acounts that the money and embezzelment was stolen from by and family member/employee.
*(I taped my conversation with my husband's the office managers/famiily member who state who stole and what she stole.)
CAN I GO TO THE JUDGE AND ASK FOR ANOTHER ATTORNEY WITHOUT FILING A STATE BAR GREEVANCE?

Re: My attorney's secretary is talking to my husband.
You always have the right to fire your current attorney and choose a new one. After your original attorney is notified that you are firing him or her, your new attorney should handle the paperwork/hearing involved in being recognized as your new representative.
A civil lawyer, such as a family law attorney, can't file or prosecute criminal charges such as embezzlement.
