Legal Question in Family Law in Texas

atty misconduct

Divorce granted a year ago and Court ordered that transfer of all paperwork/settlement funds be completed within 30 days of decree. Atty still has not submitted the QDRO for Court's approval. Atty also has not filed the AID as amended by both parties, which by reference is a vital part of the decree. Atty holding these docs ''hostage'' until bill is paid in full. Atty should have filed these docs long before preparing final billing. I am disputing a number of the fee charges, otherwise payment would already have been made. Is there anything I can do to get this divorce concluded? It was filed in 2004.

You will need to actively dispute the fee and not simply refuse to pay. You can complain to the bar, but that won't necessarily work if you owe the attorney. I'm afraid you may need a new attorney to determine what should be done. I can always talk with your attorney and try to get this resolved.
