Legal Question in Family Law in Texas

Back Child Support

My divorce was amended when I took custody of the oldest of 2 sons. My ex kept custody of the youngest. My child support was amended to a lower rate due to this. In the modification it states I have '' the power to recieve and give receipt for payments for the support of the older minor child''. She was not instructed to pay me at that time. After the younest turned 18, I was relieved of my support so I assumed everything ended. Seven years later she is wanting support she claims I did not pay. Can I still go back on her for support for the oldest I had custody of?

All I want is for her to cancel any money she feels I owe, I don't want hers, but I was hoping to use this as recourse to get her to drop this mess. I paid all support I was responsilbe for. I never had her pay her share of 50% of the medical bills for the oldest I had custody of and he ran up some high medical bills. It was because of my family, the youngest has graduted from college. What can I do to get her off this. The child support people can't believe she is doing this after all these years. Again, I want nothing from her but for all this to zero out and lets go on with our separate business.

Thanks for your help.

Re: Back Child Support

Based on what you have stated and the Texas Family Code, there is a possibility that retroactive child support may be applicable. Normally, the limits are four years back. The court can shorten or extend that four year period depending upon the circumstances. If my law firm can assist you with this legal issue or any other legal matter or any other legal issue, please contact my legal assistant Jennifer ([email protected]).
