Legal Question in Family Law in Texas

Back child support

Same story different question . 2 children $400.00 a month c/s for both . One child lived w/ ex for a while and now she is back w/ me . Ex continued to pay c/s for child living w/ me ( which was 1/2 of court ordered c/s) . Now both girls are back at home w/ me . Ex is NOT paying full amount of c/s owed to the girls . His reason is that since he continued to pay for child w/ me . He shouldn't have to pay me the full amount . Either right now or ever again ... not sure what he is thinking .

Anyways , he hasn't paid full amount of c/s since 8/12/08 . Will he be ordered to not only pay full amount again , but back c/s also ? I can't afford another attorney again . So I am trying it through the OAG's office . Will they make him pay from 8/12/08 ? I am NOT asking for $ from when child was living w/ him . Only the $ from 8/12/08 . As it was agreed that while 1 child was w/ me and 1 w/ him he wouldn't have to pay , heck I wasn't even expecting him to pay for the one that still lived w/ me . I'm also asking for a modification . Since it's been 6 years since last mod. . He made $1600.00 a month in 2002 now I'm guessing he makes around $2200.00 . He has no car payments and lives in his deceased mothers home , low bills and what not .

Bluntly, whatever happens, is what will happen. This question appears to have been asked and answered several times. The OAG has a caseload of thousands, and yours will get minimal attention. There will be an effort made to negotiate an agreement, and if unsuccessful, then it will be presented to the court, to decide how to allocate the obligations.
