Legal Question in Family Law in Texas
Back Child Support
********TEXAS**********
Husband had a fling when he was 16. 11 years later he finds out that he has an 11 year old daughter. Mother of child is suing for back child support & obviously child support until the child turns 18. This woman intentionally kept the child's existence f/my husband & has made it known that's she's "going to really stick it to him". Are there any laws that actually protect men who are NOT dead beat dads? The hearing we went to today was like the judge was basically moving cattle. None of the fathers were given a chance to speak. Can we get a fair trial? Can he be given the opportunity to speak to the judge &/or trial? He totally accepts the financial responsibility f/here on out, but what about the back child support - he had no idea. We have 2 kids of our own. Would sincerely appreciate any information you can provide. TEXAS

Re: Back Child Support
There are defenses to the payment of back child support when the mother of the child did not make reasonable attempts to put the father of the child on notice of the existence of the child. I've had numerous cases where such defenses were sucessful.
Re: Back Child Support
There are several ways to defeat her claims. One is to get her to admit that she with held the child from him. We recently won such a case and kept our client from having to pay for 14 years of back support.
