If you go back to court, a year later, to adjust custody, can an ex spouse try to accuse you of infidelity and subpoena text records trying to prove it?? they had suspicions before divorce was final but never brought up. Especially if I'm already re-married or going to be remarried?

No. In a modification the evidence is limited to conduct dated after the entry of the last order. You will need a lawyer, as it is an example of knowing when and how to object to evidence.
