Legal Question in Family Law in Texas
Back pay & rights
I have a three year old daughter and have never received child support from her father. I have never filed child support on him in hope that he would do it on his own. I am finally tired of waiting for him to do it and have decided to file against him. Someone told me that in Texas if a father owes three or more years in back child support he is ordered to pay you child support but he loses rights to the child because he owes so much money. Is this true? He doesn't see my daughter much and I don't think that visitations are an issue but I want to know if this is true.
Thank you for your help.

Re: Back pay & rights
If there is a court order requiring that he pay support, you are owed the money. If you have not received any court ordered child support, it is possible for your child's father to lose visitation rights and parental rights, but if he loses parental rights, he is no longer obligated to pay support. You can hire an attorney to sue for back suppport, or you can contact the Texas Attorney General's Office.
