Legal Question in Family Law in Texas
Background check
My daughters mother is marrying again whithin three months of meeting someone. Last time she made this decision I asked for the guys info so that I could run a background check, she let me and everything was on the up and up. The marriage lasted one year. So here we are again. My daughter lives w/ my wife and I and her mom sees her every other weekend. We have joint conservitership w/ some very iron clad clauses that she contacts me before leaving my daughter w/ an underage adult, she cannot make any major decisions for my daughter without me, so to speak. She introduced me to her new fiance and I am sorry to judge a book by its cover but this guy is from the basement of the library. I asked her to let me have his personal info for a back ground check and she refused. I want to know what my rights are in order to run a background check on someone in order to protect my daughter from any wrong doing. I pray that you can help.

Re: Background check
I don't know how old your divorce decree is, but current decrees require that a spouse provide this information, or risk being held in contempt. Read your decree. If it contains the language, just reminding your exwife of the language might be incentive enough for her to give you his info. If not, you are going to have to take her back to court to force the information from her. If you know his name, most counties carry public records online -- you may be able to find it out on your own.
