Legal Question in Family Law in Texas

Bad results from good faith

I was never legally married to my son's father. Due to medical problems I had to take my child and move home with my parents, obtaining Medicaid and thus having the state order my son's father to pay child support. After explaing to the judge that my son's father would, in good faith, do all that he could to make sure that his son was taken care of and that I was not pursuing support myself, I had the support lowered to the minimum amount to be paid. Since then, he has shown nothing of good faith and has only been to see his son 3 times in the last year. How can I go about raising the child support to the amount I am suppose to recieve? Is there any way that I can change my son's last name to my maiden name?

The local AG will help you - it may takes months - but they will file a modification of parent child relationship for your meaning increase in child support based on substantial and material change in circumstances. The AG is free. If father is here in Tx a private atty can do it as well but would not be free - just faster. Of course if the father is a deadbeat with no job the most you can hope for is that he will be thrown in jail and wake up and start paying. I am not your atty and I do not represent you so please note this is not legal advice to a client. Thanks you and good luck.
