benificiary for divorced parent

If my ex-husband of one year died in an accident, but still had me as his benificiary would my divorce decree supercede me claiming his estate for our son? My financial advisor said that I would still be the benificiary, but my father in-law said his lawyer said ''The money would not go to me, or would go to probate''. Please advise

Rather than a financial advisor (who is closer to being correct) or an ex-father-in-law (who is incorrect), i suggest you hire a lawyer if the policy is of any value. It will cost some money, but this could be done on an hourly rate and be affordable.
