my bf and I have a 10 month old daughter. things are not working out so i told him was going to move to lubbock 400 miles away form Dallas. so he filed on me with the purpose to restrict the childs residence close to him.
we dropped the temp order hearing in hopes to work things out. but the case was not dropped, it was moved to pending status. and i never answered the motion.
well things didn't work out, so when he was gone at work i gathered our stuff and left to my brothers house. its been 9 days and i refuse to tell him where we are. will i get in trouble for that ? hiding the child from him. he is legally the father, registered with the state.
he does not want me to move far away with the baby, but i have no job and cant support myself or the baby. he has paid all the bills the last 20 months.
so if i move home with my parents so they can pay my bills and i can go to school.
since he can afford to raise the baby on his own and i have no job or anything could the court give him primary joint ? and or not allow me to move the baby far from him.
i just dont want to look bad for hiding, i am just scared.

Get your parents, or someone, to help you hire a lawyer today. You could very well get into trouble. There is a felony that addresses interference with child custody. There may or may not be current court orders in your case, as the Standing Orders of the Court could still be in effect. Even if there is not a criminal charge, you could still be in contempt. The court's tend to restrict residence to promote a relationship with both parents. Hiding a child from another parent, when that parent is not dangerous to the child will significantly affect your custody case. Hire a lawyer today.
