Legal Question in Family Law in Texas

I am in a big mess. Trying to get a divorce but I am pregnant. My husband doesn't know I'm pregnant and its by a different man. The paper for divorce are asking if I'm pregnant. Im wanting to know if I lie and say I'm not once my child is born will the birth certificate be put in the the same

file as divorce decree and will this all catch up with me when they see I had a divorce, five months later I had a baby. And if the father later finds out I was pregnant could he try to get me in legal trouble for lying. We have been not together for almost a year and live in different states. He sees whoever, I'm sure and I've been seeing someone and now am pregnant. We haven't been cheating. Very clearly we both know we are no longer together and the only communication is about the divorce. I know its wrong but I'm just hoping I can cover up this pregnancy until I'm divorce and then start my life with my new family but what questions will they ask once my child is born for the birth certificate information. As I said its just a big mess. Please help.

Birth records and divorce records are not kept in the same "file" in Texas.

There is an agency in Austin, TX called the Bureau of Vital Statistics that keeps track of all divorces and other vital statistics for the State of Texas. You can look on the website and learn about everything they do. You might want to call them.

You might want to talk to your gyno about what is asked at a child's birth. I think they ask your name and vital information. Then they ask the same information about the father. In Texas, if you are not married, they usually do a DNA test to add a man's name to a birth certificate.

What you describe happens frequently.

I cannot and will not instruct you to lie on a court document.

I hope this helps.
