Bigamy

my husband has remarried another woman and didnt obtain a divorce. Can he be prosecuted by law and be made to pay for a divorce.

Bigamy is a criminal charge to be prosecuted by the DA. You can file for divorce as a civil matter, but whether the judge would order your husband to pay is entirely within the judge's power.

I agree with the last response. Bigomy is surely a "fault" factor that a court will consider in deciding how to divide your community assets and liabilites, including ordering him to reimburse you for your attorney's fees incurred in the divorce.
