Legal Question in Family Law in Texas

Bigamy in Texas

My father was divorced from his 2nd wife in 1999. They have an adopted son together. My father has since remarried. We found out that my ex step-mother was married and never divorced from a man 9 months before she married my father. She is now giving him all kinds of legal grief re: child support, etc. If she never got divorced from her previous husband, and she and my father were together for approx. 18 years, would my father's and stepmother's married be ''voided''?

Re: Bigamy in Texas

I can't tell what the purpose of your question is, but the wife was guilty of bigamy while she was married to your father. When your father divorced her, the bigamy was cured. With regard to child support for the adopted child, that was an obligation that your father assumed independently of the marriage from a legal perspective, and he will likely be legally bound to support the child.

If they had a child together, it makes no difference whether they were married. He still owes child support.
