Name on Birth Certificate

How does my son get his name on my granddaughters Birth cirtificate? There was a guestion of paternity at birth, but test showed that my son was the father. He never had his name but on the birth certificate. Now my granddaughter is almost 5 and he has primary custody of her. She lives with Us (Her grandparents) and we want to get her registered for school next year. She thinks her last name is the same as my sons but the birth certificate say different. How do we get this changed. The mother has not been heard from in more than 3 months and noone seems to know where she is.

If the SAPCR that gave him primary conservatorship also includes a finding of paternity, a certified copy of the order may be sufficient to send to Bureau of Vital Statistics to get the name changed. If not, then he can request a court order name change or a paternity finding. In either event, the mother will have to be notified. If her whereabouts are unknown, then the court should allow substituted service.
