Legal Question in Family Law in Texas

bonding?

My spouse is a British National. In a motion to modify our current possession/access orders he has asked to take our children out of the US and a temporary order was granted.

He has taken the children out of the US before during our separartion. He took advantage of my vulnerable state. He told me that he wanted to work out our marriage and would be better for our children to stay with his parents.

He made me sign a paper, stating that I agreed. Once the children were with his parents he asked for a divorce. I as devistated.

I found that there was NO financial assistance with legal expenses and there was not much I could do. With a great deal of patience and some devine intervention our children were returned to me six months later.

It comes literally down to his word against mine and this document he had me sign. I do not trust him anymore and with good reason.

I want to be more prepared. I was told that I can ask for him to be bonded each time he takes the children out of the country.

What exactly is ''bonding'' and how does this work?

Re: bonding?

A bond is similar to an insurance policy. It can be posted by a surety company, or cash.

Under such a policy, he would be required to post a bond in a certain amount with the registry of the court. If he violates the conditions, then the bond is payable to you as compensation for the violation. Although it does not solve your problem, it is meant to deter him from violating the order, and it provides funds for you to track him down.
