Legal Question in Family Law in Texas

My boyfriend and I just found out that my son is not his but he signed the birth certificate. WE did a DNA test through the mail. He wants the responsibility of being his father legally. Is there anything we need to do to make it official or does him signing the birth certificate constitute this?

Talk to an experienced family lawyer, as there are potential minefields here that you will need to avoid. There are probably several avenues to take, but based upon the limited information you have provided, the biological father's rights, even if unknown, should be terminated, and your boyfriend can adopt him. The court may hesitate since you are not married. Upon a detailed examination of the specific facts an attorney may have alternative options to recommend.

To rely solely on the AOP and the birth certificate, particularly since you don't mention marriage, could lead to problems down the road.
