Legal Question in Family Law in Texas

My boyfriend is currently incarcerated,hes been in jail since November 2010. We've been together for four years now. The jail facility he is in says that he can only have contact visits with a spouse or family member. It also says if we have a common law marriage I can be approved for contact visits but I will need to provide proof. Does he need to be present in order to fill out the required paperwork at a court?

No. Just fill out the declaration of informal marriage, have him sign it before a notary, and then you can file it at the courthouse by yourself.
