If you have an existing paternity decree issued out of Harris County, it would be difficult to move to Austin unless you both agree. Then of course, you can come back to Houston by agreement. If a paternity action is brought in Austin, then it may be very difficult for you to return to Houston with the child. If you want to reside in Austin, you will need 90 days in that county with the child. Otherwise, he might try to allege that Harris County is the appropriate venue.
