my ex boyfriend is threathening of taking me to court for custody of our son. he lives 6 hrs away and has never supported our son. can he do that even though he has no job and lives with his mother.

Yes, he can file a paternity suit and ask for custody. He probably would not be awarded custody.

Yes, anyone can sue you at any time for any reason.

So technically, I can sue you for custody of your child even though I've never met you.

I would not win but I could file a lawsuit against you.

My advice, find a lawyer NOW in case he files a lawsuit. Have your money saved so that you are ready to move if he EVER files a lawsuit!

I suspect that he's merely bluffing to scare you but you need to be prepared.
