Legal Question in Family Law in Texas

My brother got credit in my deceased father's name. He was given the family home by my mother that was paid for, then he mortgaged it because of his greediness. How do we stop him without losing the family home if he goes to jail for identity theft?

Your mother gave him the home. It is his.

If he took out a mortgage and is unable to pay the mortgage then the mortgage company will foreclose on it.

So if you don't want to lose the house someone is going to have to make the mortgage payments.

Or, one of the family members can buy the house from your brother and get a new mortgage.

I would encourage your family to sit down with an attorney to discuss this matter.

Identity theft is a separate issue.
