Legal Question in Family Law in Texas

If my brother is in the hospital an his wife has advised the hospital not to give his family any information about him or let us see him what can I do. She does not have power of attorney on him. But the hospital is abiding her wishes. I feel my brother will die soon and I'm not able to be with him. Also we question if she had a part in him getting hospitalized in the first place.

She is his next of kin.

You could ask the hospital minister to let you know how he is doing. He/she might do that.

If your brother is a member of a church, perhaps his minister will let you know how he is doing or talk to his wife.

I assume that she is very upset about her husband and the fact that he is possibly dying. Many people deal with grief badly.

You can go to court and ask the court to allow you access to your brother. You need to immediately consult with an attorney that handles probate/elder law issues in the county he lives in.

I'd look on this website and on www.avvo.com for an attorney.

If you are in Harris County, you can call me for a referral at 713-847-6000.

I'm sorry that you are going through this.
