Legal Question in Family Law in Texas
how to calculate net income
In the State of Texas, I am currentling in a lawsuit with an ex spouse. I am re-married and receiving child support from an order that is 3 plus years old. My ex now makes considerably more money, but wants to limit his support by subtracting business expenses as well as insurance costs from his net income. Is this consistent with the law?

Re: how to calculate net income
Net income means just that - net. If your ex owns a business and has to spend money to make money, he will be entitled to use those proper deductions. However, sometimes those deductions must be closely examined because it is not the same calculation as a tax return.
Insurance - yes - he is entitled to a dollar for dollar deduction for health insurance premiums paid for the children - once again, from his net, not from the monthly child support calculation.
