Legal Question in Family Law in Texas
I called child services in Texas on a neighbor and their daughter and drug use.they were investigated and now this guy says he has a lawyer who is going to get the phone records from CPS and find out who called on him and get revenge.I called hotline and never gave my name so can he do this through the courts or get judge order and find out who called on him?
1 Answer from Attorneys
That information is protected by a statute that ensures its confidentiality, and there's no way that an attorney that he hired is going to get a judge to order the release of your information. The only real exception to that would be is that occasionally it's very obvious from the initial CPS investigation that someone has made a malicious false report. When it appears that is the case, the police are notified and a criminal case is filed for the false report. Otherwise, CPS reports are always confidential--I would imagine your neighbor suspects the referral was made by you or another neighbor and is just trying to scare you into confessing.
