Car Note

My husband is in jail and I want t o divorce him. We have a car together, I am cosigner. When we divorce who gets the car?

If you do not present an agreed order to the court, the court will decide who gets the car based upon the evidence presented at the hearing. Generally, if the car was obtained during the marriage, it is community property. That means that each of you are entitled to half of the equity and half of the debt. Often, whoever gets the property, gets the debt.
