Legal Question in Family Law in Texas
When I don't carry the insurance, why bill me for the child's office visit?
My ex-husband is responsible for the medical insurance for 3 children. The medical insurance is under his current wife, not him. The children live with me. He has had the responsibility of the insurance since June 2007. Although the decree states that he is to send me the explaination on benefits & updated cards/information he does not. Dr. offices see me as the guarantor of the bill since I take the children to the office and so they bill me and not him. Dad will not pay his half and I get stuck with the full amount for the dr. visit. Is it right for the doctors office to use me as the guantor for the billing/responsible person when I am not the one carrying the insurance?

Re: When I don't carry the insurance, why bill me for the child's office visit?
The doctor's office is a third party and can bill whoever they want, in this case the person who is bringing the children to the doctor. If you are properly informing your ex of his share of the uninsured expenses and he isn't paying his share, you can file an enforcement action against him. Talk to a good local family law attorney.
