Legal Question in Family Law in Texas

what are my chances of keeping my kids they have lived here in bexar county in my moms house for over a year. her mom lives in dallas and that is where she took the kids when she left me. the same day she came and took every thing that we had together I went to dallas and got my kids. if I file a divorce would that help me get the court order stating where the kids live?

Until there is a court order, either parent can take and move the kids. If the kids have been living in bexar county long enough, then your your mom can file for conservatorship so she can take care of the kids or you can file for divorce. Either way there would be a court order establishing the principal residence of the children as well as visitation rights and child suppport for the possessory conservator
