Name Change

How old does a child have to be to change his name. The father still has custody, but has not seen child in 7 years, but pays child support. The biological father has no relationship with child. The child wants to take step fathers name.

Re: Name Change

Under the Texas Family Code, to change the name of a minor child (anyone under 18), notice will have to be given to the Father. As long as he is the legal father and objects to the name change, a court is unlikely to change the name. However, once your son is over 18 and graduated from high school, such that he is no longer a minor, then he can bring a name change petition without giving notice to his biological father. It is quite simple then at least under current law.
