Legal Question in Family Law in Texas

Name change

I have two children ages 16 and 14. They have been estranged from their biological father for 11 years. He had virtually no contact with them. I re-married and their step-father raised them as his own. The step-father and I have recently divorced as well. However, he has remained a father to my kids. My 1st husband, bio. father to kids recently married MY SISTER! My kids are very upset about it, and want to legally change their names to their step-fathers name which is my last name as well. I do recieve child support from their bio father and can't afford to not have it. I had to chase him down for it, and he owes a lot of back child support. Can my children request a legal name change without my loosing the child support? Again, they are ages 16 and 14. They don't want anything to do with their bio. father and are insulted that their aunt now has his last name as well. They want to cut ties with them both. But, I depend on the child support to take care of them. What can I do?

Re: Name change

I'd wait to do an adult name change when they turn 18. It's much easier.

If you do it while they are minors, the father will need to agree to it.
