Change of custody

After we file a modification of custody, is it even going to be possible to gain custody when there is no form of abuse in the home. My daughter says that she feels like she is living in that house all alone. She is taken care of financially but is not being cared for emotionally and she has tried talking to her mother about it. It's out of her hands.

It depends -- modification of custody does not require abuse. It is an issue of what is in the child's best interest. Normally the court is not eager to change a child's status quo, but will if presented compelling reasons to do so.
