Legal Question in Family Law in Texas

Change in Custody and Visitation rights.

In my divorce my ex-husband has custody of my

daughter (17) and I have custody of my son (11). My Ex

husand has kicked my daughter out of the house

because she didn't go to school for a week. He also hit

her. I need to know if I can check her out of school even

though I'm not the Primary custodial parent and how to

file for change in custody and also supervised visitation

rights for my son because his father drinks and drives

when he is with him.

Re: Change in Custody and Visitation rights.

You should speak with a family law attorney about modifying the custody. Since your daughter is past the required age she should be able to tell the judge who she wants to live with and why. The court usually looks to what is in the best interest of the child.
