My ex wife thru our disillusion agreement in 2003 was she gets the kids during school year and i get them in the summer, however this summer It was a mutual verbal agreement set forth between my ex-spouse and I, to allow my son stay this year and attend school in Texas instead of alaska. This will be the first year of 6 that I have lived out of the state of Alaska, which my son will be able to live with me for a school year. It was on the day of July 20th, that my ex-spouse decided, for no justifiable cause, to terminate this agreement and verbally force me to send him back to Alaska. This will only hurt my son, for he wishes to stay. I need to know what will happen i fi choose to keep him here against my ex wifes wishes. my son wants to stay here with me for many reasons. Im his dad and the boy wants to be with his dad. he is tired of living with his two sister and mother without any male figure in his life in alaska.please advise...dm

Verbal agreements have no effect on the custody language of the divorce decree, so you have very little to rely upon there. However, your son might be able to make an election to stay with you. You should see an attorney right away to discuss your potential choices on these significant legal issues.
