Name Change

I had my daughter while still living at home. I am married now and my husband and I want her to have our name. Her biological father has nothing to do with her, he is not on her birth certificate, and she does not have his last name. Does he have to be contacted for the name change to take place?

Re: Name Change

Yes. Even though he has had nothing do with the child, he is still the natural father with parental rights. You cannot effect those rights without notice and permission. Permission would have to be in the form of a court order.
