name change

I would like to change my daughters last name to mine and my husbands last name. She has my maiden name now and wants to have the same last name as me and the man she calls daddy. She does see her biological father from time to time and we did go to court in the past over child support and visitation. Her last name however has always been my maiden name and her biological father is not on the birth certificate.

It might be wise to talk to the biological father first. If he agrees to the change, it's a fairly simple procedure. If he doesn't agree, the Court may not grant your request.

You would file a petition with the court, and you will have to notify her bio father of the proposed name change. He has a right to be heard at the hearing.
