Is it possible to request NY Family Court to allow jurisdiction to be transferred to TX which is the state of residence of the custodial parent and child?

Statutes differ to some degree from state to state; however, I believe NY has a Uniform Child Custody Jurisdiction Act in its statutes. It should state where a modification suit needs to be filed. If the last order was entered by a NY court, your modification suit is going to have to start in NY. The statute probably will allow you to ask that the case be heard by a Texas court under certain circumstances.

You need to retain a NY lawyer to assist you with the initial steps and hire a Texas lawyer if the NY court allows the case to be moved.
