name change for minor children

I want to have the names of my children from a previous marriage changed to my married name. Their biological father lives 1000 miles away and sees them very little (3 days a year) and though they love him they consider their step-daddy their real daddy and they use his name. They want him to adopt them. They are too little to make any decisions in these matters but we are having some difficulty as usual during school registration as we do each year, because what they want to go by is not their legal name. What they write on their papers and what they call themselves is not their legal name. Since we reside in Texas and have for the past 3 years, can I petition a court in Texas to change their names? The divorce took place in Alabama? Since this does not change custody or child support or rights of the father, can't it be done where the kids live? I know he will be notified of a hearing and given the opportunity to stop this from happening. But my 10 year old came home crying yesterday from school because her teacher told her that she could not use the name she has been using, she has to use her legal name because it is just too confusing. So I need to do something.
