Legal Question in Family Law in Texas

Name Change in Texas

My son is 13 years old. His biological father walked out on us when my son was 3. He hasn't seen him since he was 4. I have been with my current husband since my son was 6. He calls my husband dad, and he is his father in every sense of the word excluding genetics. My ex husband has never paid me a cent of child support and I have no idea where he is. He has an extensive criminal record and may be in jail for all I know. My son desperately wants to carry my husband's last name...I can't imagine how he must feel being the only one with a different last name when he is just as much a part of the family as the rest of us. How do I legally change his name? We cannot afford a legal adoption at this time, but we are saving up.
