Legal Question in Family Law in Texas

Name change of my 9 yr. old

I have a 9 year old who's father has never wanted anything to do with him, never paid child support, never even seen him (by his own choice). I am now married and would like to change my son's last name to my married name. I don't know where the father is. Do I need his permission to change my sons name? Can I do a name change on my own?

You can do it but you will need to attempt to reach

him or serve him by publication...you can't just ignore

him. If you want an adoption, you must terminate his

rights prior to the adoption. The process is somewhat

complex, but many family law attorneys can step you

throught the process. Obviously, you also will have

some costs involved (at least $1000 if not higher)

although the exact amount is impossible to say. Email
