Changing my daughter's last name

The father of my daughter left 7 months ago. He stole my vehichle and left us with no money and has not sent any. He is doing drugs. He has 3 other children and does not support them either. I would like to change my daughter's last name to mine since he seems not to want to help me raiser her. Can I do it without him signing away his rights. He is in no other way in her life and I still have not recieved any support and don't really expect to. I don't want him to sign any of his rights away, I just want her to have my last name.

He does not have to sign away any of his rights, however, he will need to sign the order agreeing to the name change. Otherwise, you will have a contested matter. TCL
