changing name of minor child

the parties are going through divorce - they were common law married. how difficult is it to change the child's name. obviously, no agreement from father

That is a decision for the judge, and absent a compelling reason, do not think a judge would easily change a child's name from their father's last name (or name that they have been raised with).
