Changing my son's last name

My son is about to be six years old and he hasn't see his bio father since he was four days old. He is not on my son's birth certificate and I do not recieve child support, never have. My husband and I want us all to have the same last name since we have been together since my son was eight months old and he is the only father he has ever known. How do I proceed?

It may be possible to have your son's last named legally changed to match his stepfather's. It might also be possible for your husband to adopt your son. In either case your first step needs to be sitting down with a good family law attorney and discussing all your options and goals. Many family law attorneys offer free or low cost initial consultations. Make sure whoever you talk to regularly handles adoptions and name changes.

Your husband will have to adopt the child and the bio father's parental rights will have to be terminated. Good Luck.
