Legal Question in Family Law in Texas

chid support back pay

Divorced in 94,wife gave up custody and divorce decree said she was to pay support after 1 yr.being she was unemployed and no education.I did not pursue her but due to lay off I applied for tanf.and attorney gen.then ordered her to pay and 1/2 med.bills/insurance,this was in 2001.but up until then nothing was paid.2 of my children,21 and 22 are on there own now.My 14 yr.old sign a paper wanting to go with her mom and I just lost custody 02/07 and am now paying my ex almost twice what she was paying me.Can I collect what she did not pay from 95 on being that in 94 the divorce decree said she would not have to pay for a year. Can I collect after the attorney gen.ordered her to pay, med.bills and insurance that she never paid from 2001 when she was ordered to pay.The attorney gens.office in TX.favors the female in these cases and I've been given different answers each time I call them from a flat out ''no''to yes but thru a court order or no on the back pay from 95 since it was a divorce decree not a court order to no on the med.bills from when she was ordered in 2001 because of the statute limits.

Re: chid support back pay

You need to hire a lawyer to help you.If support is ordered in the decree then your spouse must pay it. One way to resolve this is with a motion to the back child support she owes you. This should be credited against your child support obligation. Be sure to ask for atty fees as well.
