child abandonment

after a divorce what is time frame to apply for child abandonment. Hasnt had contact in over 4 years and not payng child support

I assume you're wanting to terminate the rights of the other parent. You cite sufficient grounds under the Family Code, but it is the decision of the judge to terminate. Many judges will not terminate rights until a new parent is available to take the place of the terminated parent. You could modify visitation to allow limited visits only in the presence of another competent adult and you could seek to enforce the delinquent child support.
