child abandonment

my sons father has not seen my son for 5yrs. nor has he paid child support, but I have never filed for custody because I am scarred to rock the boat. If he has known how to contact us, is this child abandonment?

Rock what boat? Discuss your case with an attorney openly and honestly. Get an informed opinion as to the likelihood of you not being named as primary conservator. Am not sure what you intend by using the phrase 'child abandonment'. He remains the child's parent with parental rights, until a court says he doesn't.
