I have a 7yr old son and his father was very abussive towards me and him . His father abused him when he was 1yrs old and he got incarserated for that, he did 4yrs in jail and got out on parol in 2007 but he has not seen my son in 7yrs. I went to court for that and they gave me a paper stating that he can not locate us or get any kind of information about us .So he didnt show up to court while he was in jail so im the managing parent and i have documents from court. My question is , im trying to change his last name to my maiden name. I got married and he considers my husband as his dad how can i get help to change his last name to eaither my married name or my maiden last name?

You need to talk to a good family law attorney. The Court's will not normally change a child's name without both parents' approval, but if your husband is willing to adopt the boy, it might be possible to do a termination and step-parent adoption.
