My son is 7yrs old and his father abused him when he was 1yr and he also abused me at the same time. my question is my son hasent seen his father in 7yrs and i want to change his last name cause i got married and he considers my husband as his dad how can i go about that. My son's dad got incarserated for 4yr's and got out in july of 07 but is currently on parole. i need help to get my sons last name changed

If the father of the child consents to the name change it will be a very simple process. If not, I am uncertain that a Court will grant the action you are seeking. There may be an alternative method for obtaining the same result, but it is more complicated. Have you ever considered a step parent adoption? You would have to be able to satisfy one of the statutory grounds for termination (i.e. father's agreement or nonpayment of support).
