Child asked to participate in a crime

My step-son (who is now 9) has just admitted to a counselor that after his parents divorce, his mother took the child (he was 7 at the time) to his father's house and opened the window and told him to take things out of his father's house (child primarily lives with his mother). His mother's then boyfriend, now husband, helped him crawl through the window. No police report was filed by the father. But with the childs admission to the counselor, can the two adults get into any trouble? Adults asking a child to perform a criminal activity should have consequences.

The man never filed a police report? Why not?

He can go to the police station but since this happened 2 years ago they might not do anything.

If he wants to modify the current custody of the child, he needs to talk in person to a family law attorney.
