Legal Question in Family Law in Texas
I had a child with an ex boyfried, we never got married, but our daughter has his last name. A month after she was born he left & for the 4 years of her life has seen her about 4 times. He filed child support on himself & we have gone to court in April 2009 for custody. The court agreed that he pay child support & get supervised 2 hour visitation which he only saw her 1 time. So to get to the point, she will be starting school soon & I hate that we have different last names because he is not in her life. What can I do to remove his rights? I do not know where is currently living or have contact info, I heard that because of that I have to put an ad in the local newspaper to announce that I will be changing her name & he has a time limit to respond or all his rights will be gone. Is this true? What are my options?

If you want a name change, you really need his permission to change her name. You are required to try to find him. Many courts will appoint an attorney to try to locate him and you get to pay for it. Their fees start at $500 and I've seen into a couple of thousand dollars.
I recommend that you talk to an attorney in your county that practices a lot in family court to
determine if you are wasting your money or if the judge might change her name.
